Mark W. Oszust is a construction attorney who represents general contractors, subcontractors, owners, and design professionals in various construction disputes involving claims for additional compensation and labor inefficiencies, design defects, indemnification, construction liens, and bonds (payment and performance). He has successfully resolved construction disputes prior to trial and has significant first-chair arbitration and trial experience. He also assists his construction clients with contract drafting, negotiation, interpretation, and proper contract compliance to reduce risk and promote successful project completion.
Mark also focuses his practice on complex commercial and class action litigation and appellate law. He has obtained favorable rulings from the U.S. Court of Appeals for the Sixth Circuit and Michigan Court of Appeals whereby the courts held that equity in real property is a protected property right under the federal and Michigan Constitutions.
Prior to joining Kotz Sangster, Mark worked at one of Michigan’s largest law firms and a preeminent boutique litigation firm specializing in construction and commercial litigation.
